State authorised to regulate school fee

A Division Bench of the A.P. High Court comprising Justice Goda Raghuram and Justice Naushad Ali on Friday upheld the power of the State Government to regulate fee structure in schools. The Bench upheld several provisions of G.O. 91 issued in August 2009 aimed at regulating the fee in private schools but made it clear that regulations have to be effective and non invasive.
The Judges held as illegal three provisions of the GO which were issued after many agitations by parents and civil society groups about the fee hike by private schools. Several writ petitions were filed by many managements of the educational institutions which challenged the constitutional validity of the G.O.They claimed that as they were affiliated to the CBSE , the State Government had no power to regulate them. Paras three and four of G.O. 91 which deal with the DFRC were quashed.
